Do you rent from a private landlord? Thousands of people who rent from a private landlord are evicted at short notice when their homes are repossessed by their landlord’s mortgage company. The Citizens Advice Bureau’s recently published statistics show that up to 6800 tenants are evicted every year when landlords get into mortgage arrears.

Thousands of people who rent from a private landlord are evicted at short notice when their homes are repossessed by their landlord’s mortgage company. The Citizens Advice Bureau’s recently published statistics show that up to 6800 tenants are evicted every year when landlords get into mortgage arrears.</p> <p>As the interest rate rises, as predicted, next year, these figures are highly likely to rise, due to homeowners struggling to meet the rise in interest rate and thus falling into arrears. Other landlords may increase rents in order to accommodate their increased mortgage costs, which their tenants may not be able to afford.</p> <p>If your landlord has a buy to let mortgage, or has an agreement with the mortgage company that states the mortgage company would take over the tenancy in the property was repossessed, you would be able to remain in the property for the remainder of your tenancy.</p> <p>The law offers some protection to tenants whose landlord is facing repossession without the consent of the mortgage company to let the property. The Mortgage Repossessions (Protection of Tenants) Act 2010 provides you with the right to request a delay the eviction for up to two months. This delay can be requested at either of two stages, when the mortgage company makes you aware of the possession proceeding, or when a warrant for eviction is applied for. If the mortgage company refuses or does not reply to this request, you can make an application to the court. This request can only be made once, but if your tenancy is deemed genuine the court should allow an application. In this two month period the mortgage company can request that you pay your rent direct to them.</p> <p>If you are renting property from a private buyer you should make sure to check your mail, as a letter addressed ‘to the occupier’, which may normally be seen as junk mail, may be a notice of eviction.</p> <p>If you find yourself in this situation and want further legal advice, get in touch with our team now.</p> <p> </p>
