If you are faced with a situation where you lose capacity to make decisions for yourself and you do not have a Lasting Power of Attorney, it is not simply a case of others making decisions for you. If decisions are required to be made on your behalf, someone would need to apply to the Court of Protection to be appointed Deputy for yourself. This process is extremely expensive and time consuming (upwards of £2,000 plus ongoing annual fees). You can take control of the situation by making a Lasting Power of Attorney.
With a Lasting Power of Attorney, you can appoint one or more persons to make decisions on your behalf. When registered, these documents become legal and can be used by your Attorneys to make decisions on your behalf only if and when you are unable to make them for yourself.
There are two types of Lasting Power of Attorney available, you may choose to exercise just one of these or alternatively both. They are:
Property and Financial Affairs Lasting Power of Attorney
As the name suggests, this can be used to give an attorney the power to make decisions about money and property for you, such as:
